New BSE testing procedures take effect from 1st January 2009

New legislation to update and amend the Transmissible Spongiform Encephalopathies Regulations has been laid in Parliament by DEFRA. RPA issues reminder to claimants of Aid for Energy Crops Scheme

The RPA has issued a reminder to producers claiming the Aid for Energy Crops that form ENC9 (which for 2008 must be signed by both the applicant and collector/first processor) should be returned to the RPA as soon as possible. Further information is available on the RPA website.

House of Lords Committee comments on draft Marine Bill

The House of Lords Select Committee on the Constitution has published a report on the Marine and Coastal Access Bill, critising the Government's decision to ignore the advice of two earlier Parliamentary committees to include a right of appeal on coastal access issues. Benn issues statement about 2008 SPS payments

Following the opening of the 2008 SPS payment window on 1st December, the RPA has been carrying out trial runs of payments and has now commenced full payments with just over £700 million paid to approximately 21,000 claimants as at 16th December. RPA issued with Decision Notice by ICO to release CAP payment data

The RPA has been issued with a Decision Notice by the Information Commissioner's Office following a complaint under the Freedom of Information Act and Environmental Information Regulations. DEFRA announces voluntary approach to Bluetongue vaccination to continue

DEFRA has today announced that the voluntary approach to vaccination against Bluetongue serotype 8 is to continue. There had been discussions about the possibility of a compulsory vaccination strategy, but this has been rejected in preference to continuing with the voluntary approach in 2009. DECC announce bio-energy capital grants

The 5th round of the Bio-energy Capital Grants Scheme has been announced by DECC. Grants will be available to businesses, charities and community organisations to fund part of the cost of installing biomass fuelled heat, or combined heat and power units. EFRA Committee announces new inquiry - securing food supplies up to 2050

The Environment, Food and Rural Affairs (EFRA) Committee has announced it is carrying out a new inquiry to look into the UK's capability to secure food supplies up to 2050. The inquiry will be conducted in two parts with the first looking at the challenges the UK faces with the demands for increases in food production and the second addressing what needs to be done by the Government, farmers, growers/producers and the food industry in order to meet the challenges. Marine and Coastal Access Bill published

The Marine and Coastal Access Bill was published on Friday (5th). It was introduced in the House of Lords on 4th December and is due for its Second Reading there on 15th December. Further information about the Bill and its progress is available on the DEFRA website.

EU authorise GM soyabean

The European Commission has authorised the use of GM soyabean MON89788, known as “Roundup Ready 2”, for import, processing, food and feed uses. The soyabean is a Monsanto product and will be licensed for 10 years initially, after it received a favourable assessment from the European Food Safety Authority. Commission for Rural Communities - The Future of England’s Uplands

The Commission for Rural Communities (CRC) will be gathering evidence for its inquiry into the future of England’s uplands during February 2009, when it plans to hold “evidence gathering seminars” and six regional meetings. The dates and places of the meetings have not yet been published. The CRC is particularly keen to hear the views of those who do not normally contribute to such a debate. Wales commences 2008 Single Payment Scheme payments

Following the opening of the payment window for 2008 Single Payment Scheme (SPS) payments on 1st December, the Welsh Assembly has confirmed that 82.5 per cent of farmers were processed for payments (exceeding 75 per cent achieved for 2007 SPS payment) with some £183 million paid into farmers' bank accounts. The intention of the Welsh Assembly is that 85 per cent of farmers should receive their payment by Christmas. Further information is available on the Welsh Assembly website....

Wales to introduce new inconclusive TB reactor policy

Welsh Assembly Rural Affairs Minister, Elin Jones, announced at the Royal Welsh Winter Fair yesterday that the policy in Wales regarding inconclusive reactors is to be brought in line with the EC Directive with effect from 1st March 2009. This will mean that inconclusive reactors will be removed following one re-test, rather than two which is currently the case. Wales suspends entry level agri-environment scheme for two years

FWi has reported that Elin Jones, Welsh Assembly Rural Affairs Minister, has decided to suspend Tir Cynnal (entry level agri-environment scheme) for two years as result of the high level of applications to their Organic Farming Scheme launched in November 2007 and a resultant need to adjust the budgets available to Axis 2 schemes over the next two financial years. UK officially free of Avian Influenza

DEFRA has announced that the UK is officially free from Avian Influenza with effect from 20th November 2008, meeting criteria of the World Organisation for Animal Health. DEFRA commits £2 million to nature conservation

Environment Secretary Hilary Benn has announced that £2 million funding to support nature conservation. A £750,000 campaign is being launched to encourage volunteering work and more than £1 million is for a new fund to improve local wildlife records in England to increase availability of information. DEFRA finds further cases of Bluetongue infection in animals imported from France

DEFRA has confirmed that further cases of Bluetongue (BTV8) have been found following post-import testing. Infection has been found in one imported sheep on premises in Gloucestershire and in a group of six imported cattle on premises in Dorset. The animals originated from France. DEFRA announces new Bovine TB eradication group for England

DEFRA has today (3rd) announced the formation of a new Bovine TB eradication group for England. This joint DEFRA/Industry group has been set up to advise the Secretary of State about bovine TB strategy in England. Membership of the group is yet to be finalised. Wales confirms additional £6.8 million funding for Organic Farming Scheme

The Welsh Assembly Government has confirmed that a further £6.8 million funding will be made available for the Organic Farming Scheme (OFS). This will mean that all applications for the 2008 OFS can be met and that a further 100 applications will be supported for the 2009 OFS. Welsh Assembly pushing for a change to fallen stock rules

The Welsh Assembly Government has submitted an amendment to EU rules which prevent on farm burial of stock so that on farm containment would be permitted prior to disposal. It however seems that Wales has not received any support for such a derogation despite strong negotiations with the European Commission. Bluetongue (BTV6) confirmed in Netherlands

DEFRA has confirmed that Bluetongue Serotype 6 (BTV6), which is a new serotype not previously found in the EU, has been found on three farms in the Netherlands. BTV8 has been the serotype predominating to date. All livestock exports from the Netherlands were banned on 20th October whilst these cases were being investigated. All future RPA payments to be made via BACS

With effect from 16th October 2008, the RPA can now only make payments via BACS as a result of requirements under European legislation. This affects all payments made by the RPA including Single Payment Scheme and agri-environment scheme payments. If farmers have not registered their bank details with the RPA, they will need to do so as soon as possible. Further information is available on the RPA website....

Deadline approaching for sugar beet compensation applications

The RPA has reminded sugar beet growers and contractors that application forms for compensation where they held contracts with British Sugar in 2006, 2007 and 2008 must be returned to the RPA by 31st October 2008. Further information is available on the RPA website.

Wales progresses with TB eradication programme

The Welsh Assembly Government (WAG) is progressing with the implementation of the TB eradication programme with the National Assembly voting yesterday for increased powers of entry to premises in order to test camelids and goats for TB, which were previously not in place. Older Cattle Disposal Scheme - last chance to book

The Older Cattle Disposal Scheme (OCDS) is due to end on 31st December 2008 and the RPA had orginally announced that the OCDS slaughter booking system would close on 30th September. However, after further analysis by the RPA, it seems that there is further slaughter capacity available and the RPA is encouraging farmers to book as a matter of urgency. H5N1 avian flu outbreak confirmed in Germany

A case of the H5N1 strain of avian flu has been identified on a poultry farm in Saxony, Germany. Protection and Surveillance Zones are in place around the infected premises. This is the first outbreak of the H5N1 strain recorded on a poultry farm in Europe in 2008. Compulsory Bluetongue vaccination to commence in Scotland from 3rd November

The Scottish Government has confirmed that Scotland will become a Bluetongue Protection Zone from Monday 3rd November 2008, allowing free movement of livestock throughout the United Kingdom from that date. The window for compulsory vaccination for sheep and cattle will also open from that date for six months, with the Scottish Government meeting half the costs of the vaccine. DEFRA confirms extension of cross compliance exemption for waterlogged land

DEFRA has confirmed that the exemption from the cross compliance standard which prohibits the use of motorised vehicles and the carrying out of mechanical operations on waterlogged soils (GAEC 3) has been extended until 25th October 2008 (the original exemption announced on 10th September was due to end on 4th October). DEFRA announces £300,000 funding for development of guidance for surface water management plans

DEFRA has today announced that £300,000 is to be made available for pilot schemes which will be used to develop guidance for surface water management plans in anticipation of increased future rainfall. Organisations or partnerships that have the capacity to deliver a pilot will need to submit a proposal to DEFRA by 24th October 2008. Scotland to introduce Home Report from 1st December 2008

The Scottish Government has announced that a Home Report will be introduced from 1st December 2008 for the sale of homes. The Home Report is to include three documents which should provide prospective home purchasers with a survey of the property (including information about the property's condition and a valuation), an energy report and a property questionnaire. Wales updates on TB eradication programme progress

Rural Affairs Minister, Ellin Jones, has provided an update on progress with the implementation of the TB eradication programme in Wales. A key initial element is the "TB Health Check Wales" which will see all herds across Wales having a one-off TB test over a fifteen month period starting from 1st October 2008, with testing due to be completed by 31st December 2009. DEFRA launches scoping project to examine forestry as renewable energy source

DEFRA has today (17th September) announced the launch of a scoping project to look at short rotation forestry and what role it may have to play in being a viable renewable energy source. A number of sites and plots will be established to look at both native and naturalised broadleaved trees as well as other species which may have the potential of being used for biomass. Bluetongue detected in imported cattle in Wales

The Welsh Assembly Government (WAG) has confirmed that Bluetongue (BTV8) has been detected in two cattle imported from France, now located on a premises near Ruthin, Denbighshire. A further animal is also under investigation. Further information is available on WAG's website.

Scotland to introduce compulsory bluetongue vaccination programme

The Scottish Government has confirmed today (16th September) that a compulsory vaccination programme for bluetongue will be launched this winter in Scotland. Permission granted for judicial review of proposed Eco-town

Bluetongue - further cases detected in imported cattle in Somerset, Dorset and Worcestershire

DEFRA has indicated today (12th September) that there have been a further six imported cattle detected with Bluetongue on a premises near Worcester. These cattle originated from Germany. In addition, a cow on premises near Dorchester, Dorset.which was imported from France has also been detected with the disease. This adds to other imported cases found over the past few days, including one cattle on premises near Yeovil in Somerset which again orginated from the BTV8 restricted zone in France....

DEFRA confirms Bluetongue in County Durham

DEFRA has announced today (10th September 2008) that Bluetongue has been detected on premises near Bishop Auckland, County Durham. This is the fourth occurence of Bluetongue being found in animals imported to the UK from the BTV8 Restricted Zone in Germany and involves 18 cattle. DEFRA and WAG grant temporary suspension of cross compliance to allow harvest on waterlogged land

As a result of the wet weather conditions experienced, DEFRA has today (10th September 2008) confirmed a temporary suspension of the cross compliance standard which prevents farmers from using mechanical equipment and vehicles on waterlogged land (Good Agricultural and Environmental Condition - GAEC 3). DEFRA publishes nitrate regulations and maps

The regulations relating to the extension of England's Nitrate Vulnerable Zones (NVZ's) from 55% to around 70% have been published by DEFRA. The maps showing the newly affected areas are due to be available early next week. Farmers will have until 31st January 2009 to appeal where they believe the NVZ designation of land is incorrect. DEFRA submits new sites as candidate Special Areas of Conservation

DEFRA has submitted seven new sites (two land-based and five marine) as candidate Special Areas of Conservation to the European Commission in order to provide those areas with an increased level of habitat and species protection. Bluetongue Protection Zone to be extended to cover whole of England

Defra has confirmed, following the announcement they made on 20th August, that with effect from 1st September 2008 Northumberland and Cumbria will be incorporated into the Bluetongue Protection Zone (PZ), which will complete the roll-out of the vaccination programme and see the whole of England included within the PZ. Bluetongue found in cattle in Devon

As a result of post-import testing, DEFRA has today (29th August) confirmed that further cases of Bluetongue (BTV8) have been discovered in eight cattle imported from Germany's BTV8 Restricted Zone. Bluetongue detected in imported rams in East Sussex and Hertfordshire

DEFRA has today (27th August) announced that two rams located on premises near Lewes, East Sussex, and Hemel Hempstead, Hertfordshire, have tested positive for Bluetongue (BTV8). The rams had been imported from the same premises located in the BTV8 Restricted Zone in Central France and are the UK's first cases of Bluetongue virus positive animals discovered this summer. Aggregates Levy Grant Scheme open

Natural England’s Aggregates Levy Sustainability Fund Grant Scheme will be open to applications until 15th September 2008. Work done under the scheme must be completed by 20th March 2009. Bluetongue - remainder of England to be incorporated within Protection Zone

Defra has today (20th) confirmed that the extension of the Bluetongue Protection Zone (PZ) to incorporate the counties of Northumberland and Cumbria will not occur prior to 1st September 2008 unless there is a change in the disease status. Bluetongue - Welsh Assembly updates on declaring whole of Wales as Protection Zone

Defra confirms livestock export restrictions to China lifted

Defra has today (12th) announced that the export restrictions placed on UK livestock and livestock products by the Chinese government following the Foot and Mouth outbreak in the UK in August 2007 have been lifted. UK livestock products manufactured outside the exclusion window of 7th July 2007 to 7th August 2008 can now be exported to China, provided the agreed certification exists. Bluetongue Protection Zone to be further extended from 11th August

The Bluetongue Protection Zone (PZ) is to be further extended from 00.01 on 11th August 2008 as a result of Defra reviewing the quantity of vaccine available in the supply chain. Defra appeals TB compensation tables decision

Following the High Court decision on 14th July, it has been reported that Defra has appealed against the decision that the use of average market values in the tabular system implemented in England for TB compensation purposes discriminated against higher value cattle. Benn accepts Curry Group set-aside recommendations

Following the final report from Sir Don Curry's High Level Group looking into set-aside, Hilary Benn has agreed that any set-aside mitigation system cannot be implemented in the 2008/9 year. The Group's preferred option would see arable farmers maintain a small percentage of land in environmental management, with proposed new "top-up" options available under Environmental Stewardship. Bluetongue Protection Zone to be extended on 28th July

Defra has announced that, following the delivery of further supplies of vaccine, the Protection Zone is to be extended from 00.01 on Monday 28th July. The extension will cover Herefordshire, the unitary authority of Telford and Wrekin and the districts in Shropshire (North Shropshire, Shrewsbury and Atcham, South Shropshire and Bridgnorth) previously in the Surveillance Zone. Bovine TB found in herd of goats in Wales

It is understood that a herd of approximately twenty goats in Carmarthenshire has been culled following the discovery of bovine TB (bTB) in the herd. Defra announces plans for Hill Farm Allowance Scheme replacement

Defra has today (21st) announced plans about how the Hill Farm Allowance Scheme (HFA) is to be replaced from 2010 by the Uplands Entry Level Stewardship (UELS) scheme, as a new part of Environmental Stewardship. Defra publishes response to consultation on implementation of Nitrates Directive

Defra has published its response to the consultation on the implementation of the Nitrates Directive. It has been decided that NVZs will continue to be designated on a selective basis, rather than adopting a "whole territory approach", which will see around 70 per cent of England being designated, an increase from the current 55 per cent situation. The Government is pursuing a derogation from the European Commission with regard to the 170kg/ha whole farm nitrogen limit, however closed periods...

RPA - Update on 2007 SPS Payments

The RPA have issued an update on the payments made under the 2007 SPS. These show that the total value of payments made is £1.434 billion which is 98.9% of the estimated total fund of £1.45 billion. The report can be found here.

NFU wins Bovine TB Table Valuations case

A High Court judge ruled this morning that the tabular valuation system currently used by Defra is unlawful. Lord Justice Stanley Burnton said that the application of average values to high-end cattle discriminated against their owners without sufficient justification. Defra were given leave to appeal. Scotland's Environmental and Rural Services launched

The Scottish Government announced the launch of Scotland's Environmental and Rural Services (SEARS) at the Royal Highland Show on the 20th June 2006. Its aim is to reduce duplication, bureaucracy and overlap and in turn deliver greater efficiency, effectiveness and speed of delivery by developing a "one-stop shop" for rural land managers and farmers. Avian 'Flu - Defra lifts remaining restrictions

DEFRA announces demonstration scheme for landowners to reduce flooding

At the Royal Show in Warwickshire on 4th July, Environment Secretary Hilary Benn announced £500,000 to fund up to two pilot projects that will explore how land management can reduce the risk of flooding. Outline proposals from suitable landowners should be submitted by 29 August 2008. These will be assessed and one or two projects selected for a more detailed feasibility study before the funding is committed. Ministerial Statement made regarding SPS 2007 payments

The Secretary of State for the Environment, Food and Rural Affairs (Hilary Benn) has today (3rd July) issued a Written Ministerial Statement regarding the Single Payment Scheme and 2007 payments. Avian Influenza Protection Zone Lifted

Defra has announced that the Protection Zone, put in place due to the Avian Influenza outbreak in Oxfordshire, was lifted at 00:01 Sunday 29th June 2008, providing that no new suspect cases had been identified. Further details can be found on the Defra website.

Bluetongue Protection Zone to be extended following vaccine delivery

Defra has announced today that, following the delivery of 2 million doses of the vaccine, the Protection Zone will be extended to cover Cornwall, including the Isles of Scilly. The Welsh Assembly Government will also declare south-east Wales to be a Protection Zone. These extensions will take effect from 27th June at midday. SPS Payment Update

Latest figures, published on 19 June, show that the total value of payments made under the 2007 Single Payment Scheme (SPS) is £1.417 billion which is 97.7% of the estimated total fund of £1.45 billion. The report can be found here.

Defra updates on Bluetongue vaccine release delay

Defra has confirmed that further to the delay of a batch of Bluetongue vaccine which was due to have been delivered during the week of 2nd June, Intervet's feedback on progress with this batch is positive and final testing is being carried out. 2008/9 performance targets set for RPA are amended

Further to the Ministerial Written Statement published on Monday (16th) in which Jonathan Shaw set out performance targets for the RPA for 2008/9, Hilary Benn as issued an amended Written Ministerial Statement which corrects Monday's Statement. In particular, the SPS 2008 payment target for 31st January 2009 has been revised from 80% by value to have been paid, to 75% by value to have been paid. Defra publishes Avian Influenza epidemiology report

Defra has today (17th) published an epidemiology report regarding the Avian Influenza outbreak in Oxfordshire earlier this month. The report has found that as at the date the report was written (11th June) the outbreak is confined to a single premises and there is no indication of further spread, but further investigations are continuing. Additional Bluetongue Vaccine ordered by DEFRA

Defra today announced that it has ordered 13 million doses of Bluetongue serotype 8 vaccine from Merial, who expect to deliver the vaccine in regular batches over the summer. It is hoped that this will ensure that sufficient doses are available for vaccination to be rolled out across England & Wales by September. 8 million doses are for England & 5 million for Wales. Avian Influenza - Protection & Surveillance Zones established

Defra has confirmed this evening (4th June) that the Temporary Control Zone established following confirmation of the highly pathogenic Avian Influenza on a farm in Banbury, Oxfordshire, is to be replaced by Protection and Surveillance Zones. Defra confims Avian Influenza in Oxfordshire

Defra last night confirmed (3rd June) that preliminary tests on chickens on premises near Banbury have proven to be positive for the H7 strain of Avian Influenza. Further laboratory testing is being carried out. A Temporary Control Zone (3km inner zone and 10 km outer zone) has been set up around the infected premises and Defra is considering whether wider measures need to be imposed as a matter of urgency. Bluetongue - extension of Protection Zone delayed

Defra has confirmed this afternoon (3rd June) that the intended extension to the Protection Zone this week into Cornwall and the Restricted Zone in Wales has been delayed due to further testing being required on the vaccine prior to its release. SPS 2007 Payment Update

Latest figures, published today, show that the total value of payments made under the 2007 Single Payment Scheme (SPS) is £1.312 billion which is 90.5% of the estimated total fund of £1.45 billion.A total of 99,437 customers have received a full SPS payment. DEFRA Bluetongue update: Extension of protection zone & future plans

Defra has today announced that the Bluetongue Protection Zone will be extended again on Monday 26 May, following the delivery of additional doses of Bluetongue vaccine. Vaccination is only permitted within the Protection Zone; therefore, in accordance with the Bluetongue vaccination plan, the Protection Zone will be extended to cover all of Devon (including the Unitary Authorities of Plymouth and Torbay). Defra has confirmed that from Monday 12th May, the Bluetongue Protection Zones will be extended as a result of the delivery of further doses of the vaccine. Bluetongue - first batch of vaccine to be distributed

Hilary Benn, Environment Secretary, has today (30th April) announced that the first batch of one million doses of the vaccine for Bluetongue provided by Intervet is ready for distribution to the Protection Zones in England. This first batch is available as 20-dose bottles. It is expected that a further larger batch of up to two million doses (in 50-dose bottles) should be released in the next few days. H5N1 in Canada Goose - 11th case in wild bird

Defra has today confirmed that a Canada goose collected on 25 February in the Wild Bird Monitoring Area in Dorset as part of wild bird surveillance has tested positive for highly pathogenic H5N1 Avian Influenza. UK granted FMD free status by World Animal Health Organisation

The UK has officially been declared by the World Animal Health Organisation (OIE) Scientific Commission as having regained Foot and Mouth Disease (FMD) free status following a three month period of no further occurence of the disease. SPS: Rooker welcomes abolition of 10 month rule

Lord Rooker has today (28th January) welcomed the abolition of the 10 month rule with regard to the Single Payment Scheme (SPS) following agreement at the EU Agriculture Council held earlier this week. He also confirmed that, for 2008 SPS claims onwards, 15th May will be the single day that an SPS applicant will need to have land which forms part of an SPS claim "at his disposal" in order to claim. DEFRA Penalties for Single Payment

Lord Rooker has advised the House of Lords (Written Answers, 8th January 2008, col 189) that: - £63 million pounds has been paid in penalties to the EU for failing to make sufficient Single Payments in time for 2005 - £7 million has been identified as a potential penalty for subsequent payments - a provision of £348 million has been made against disallowances by the EU for breaches of rules on making payments under SPS for 2005 and 2006 as well as previous schemes....

Double tagging of sheep and goats takes effect

Double tagging of sheep and goats takes effect from today (11th January) which sees a requirement for any animal born on or after 11th January needing to be tagged in accordance with the new rules as well as any animal not officially identified by this date. Animals with a single tag prior to 11th January can continue to be indentified with the single tag. Defra has today confirmed Avian Influenza in three dead wild mute swans in the Chesil Beach area in Dorset, following positive test results from the Veterinary Laboratories Agency for the highly pathogenic strain of H5N1.
