Foreword

Since 2013 and the second edition of the Agricultural Valuer’s Guide to Residential Tenancies, we have seen a wave of regulatory activity affecting the private residential sector warranting the production of the Update. Driven variously by EU legislation, political concerns about the sector when a generation of young people are growing up with only a limited prospect of owning their own home, court decisions and other issues, new and impending legislation covers, among other matters, tenancy deposit protection, redress schemes, retaliatory eviction, energy efficiency, landlord and letting agent registration, consumer protection, health and safety, the immigration status of prospective tenants and other residents and, in some areas, the notification of tenants to utilities for water and sewage bill collection.

A second striking feature is the growing divergence in regulation with devolution. This text captures the current state of these developments in each of England, Wales, Scotland and Northern Ireland, with the approach reflecting the instincts of each government. The CAAV is distinctive in being able to review and compare the situation in each territory, seeing the larger picture across the United Kingdom; the more so with the May Council’s decision to approve the Northern Ireland Rural Valuers’ Association’s application for affiliation to CAAV.

Residential letting agents dealing with all these changes will need to review their office procedures and already comprehensive check lists will, of necessity, have to become longer.

The main Guide remains the overall review of these issues in England and Wales for valuers, primarily concentrating on statutory and non-statutory occupational arrangements, outlining the regulatory framework and considering practicalities. This update supplements that guide.
