Tenancy Agreement for Full Tenancy under the Agricultural Holdings Act 1986

Published in December June 1997 and re-issued in December 2006, this is the only generally available form of tenancy agreement for full tenancies under the 1986 Act.

It can be used for successions or recording/ modernising the terms of existing agreements.

With the kind consent of the Estates Gazette, the CAAV has updated the Agreement so that a familiar pattern is available for landlords, tenants and their advisors to adapt to their specific needs. As with the old Estates Gazette agreement, it was published in consultation with the Lancashire Agricultural Valuers’ Association, the Cheshire Agricultural Valuers’ Association and the Lancashire, Cheshire and Isle of Man Branch of the former Rural Practice Division of the RICS.

It is essentially the same as the 1988 Estates Gazette agreement but:-

1. More space has been introduced to record the details of the parties, the unit and the tenancy
2. More space has been included for extra clauses and references to rights of way
3. It has been updated for revised laws and regulations, Council Tax, VAT on rent
4. Provision has been made for where either party is a limited company
5. Opportunity to have the President of the CAAV appoint arbitrators or independent experts
